So I can't do a system transfer because I don't own my 3ds anymore since I sold it to gamestop awhile back so my question is when I get a new 3ds if I still know my ID will I still be able to download my games?

You'll have to put a call into Nintendo so they can unlink your NNID from your previous system so you can log into any new system you get.
The number in the US is 1-800-255-3700.
Politely explain the situation. It will take a day or two, or a weekend. Good luck!

It depends on the person who they're talking to. There was a cool guy who got my account unlinked in 2 hours.
