The thing is, Captain Toad is built around a limitation, so I think people have somewhat of a point when they say "he can't jump". I think there are creative workarounds, though.
If there is a game Mario is playable in, I main him.

Yeah, the examples here were especially bad considering Link jumps even as far back in OoT and MM where he jumps (or even frontflips) whenever near an edge to another edge, and the FE characters often have many cutscenes, skills or even regular attack animations that involve jumping. I am not an MGS fan, but pretty sure Snake jumps off plenty of things and nothing canonically says he can't. He's a human like the rest of us.

However, the second part of your post is where you hit the nail on the head. There is a big difference between characters that do not inherently show the ability to do something and characters who are outright said to not have the ability to do so.

For instance, just because I've never seen some random guy on the street throw a punch, doesn't mean I should assume he can't. Nothing about him points to not being able to throw one. However, if someone on the street is wearing a sling and cast on both arms, that's completely different. I've seen the same amount of punching from both: 0. But I can make a reasonable assumption for one and not the other. This all applies to the jumping argument. There is a big difference between characters who do not showcase jumping, and a character who outright is stated to not be able to jump.

Mega Man can't duck but that doesn't stop him from doing it in this game.

Ness and Lucas can't even use any of their special moves in their respective Mother games (sans PK Flash for Ness).

The PK Starstorm trophy in Brawl mentions that Ness was probably taught the move by his friend Poo for use in Smash Bros

This implies that these characters "prepare" for their debut in these Smash games by practicing new moves off screen. You could say that Captain Toad prepared for his inclusion in Smash by learning to jump or getting a lighter backpack. Sure this may mean that he isn't being portrayed 100% accurately but that hasn't stopped Sakurai from giving Ness and Lucas their moves, or giving Fox the ability to catch on fire for his up B. Sonic has even been stated as not being able to swim yet he can still do it here.

They could still reference Captain Toads usual inability to jump by making his jumps in Smash Bros short and awkward, displaying that it is something that he has only just learned how to do, and it is something that he has to struggle to do.

well logically, there no way he can't jump at all just because of hos bookbag. maybe he can't jump high but he should be able to jump some way.

Again, one of his attacks can be throwing the backpack. Until it respawns on his back, he can jump.

That would change his..moveset entirely though, wouldn't it? Isn't that something they were trying to avoid, by separating the characters who could change, like Samus and Zero Suit Samus?

I would rather have regular Toad, tbh. Captain Toad can be an alt costume for him though.
